By submitting this RSVP, I acknowledge that I am accepting these terms on behalf of all members of my household. I further confirm that I am an adult and am submitting this RSVP on behalf of any minors in my household who will be attending the event.

Neighborhood Event Liability Waiver and Release Agreement
Event Name: Whispering Woods Rock the Block Party

IMPORTANT NOTICE
This event is sponsored by the Whispering Woods Homeowners Association and hosted by its Communication & Social Events Committee. No individual homeowner, volunteer, or vendor shall be held personally liable for any incidents arising from or related to this event. By RSVP’ing online or entering the event space, you acknowledge and accept the terms of this Neighborhood Event Liability Waiver and Release Agreement on behalf of your entire household. Each child must have an adult RSVP on their behalf to attend.

1. Assumption of Risk
By attending this event, the undersigned participant (“Participant”) acknowledges that participation in neighborhood events may involve inherent risks, including but not limited to slips, falls, accidents, illness, or other injuries. Participant voluntarily assumes all risks associated with attendance and participation.

2. Waiver and Release of Liability
Participant, on behalf of themselves and their heirs, executors, administrators, and assigns, hereby waives, releases, and discharges the Whispering Woods Homeowners Association, its Board of Directors, officers, agents, volunteers, committee members, vendors, and any affiliated parties (“Released Parties”) from any and all claims, demands, actions, losses, damages, or liabilities—including but not limited to personal injury, property damage, or death—arising out of or related to participation in the event, regardless of cause, including negligence.

3. Indemnification
Participant agrees to indemnify and hold harmless the Released Parties from any and all claims, damages, costs (including attorney’s fees), or liabilities arising out of or related to their participation in the event.

4. Consent to Medical Treatment
In the event of a medical emergency, Participant authorizes event organizers or emergency personnel to provide necessary medical care. Participant agrees to release the Released Parties from any liability related to such treatment or the lack thereof. Participant acknowledges that no medical insurance or coverage is provided by the HOA for this event.

5. Communicable Disease Acknowledgment
Participant acknowledges the contagious nature of communicable diseases and voluntarily assumes the risk of exposure while attending this event. The Participant agrees that they and any attending household members are participating voluntarily and assume all such risks.

6. Parental Responsibility for Minors
If RSVP’ing on behalf of a minor, Participant affirms they are the parent or legal guardian with full authority to agree to the terms of this waiver for each minor attending.

7. Code of Conduct
Participant agrees to act respectfully, follow all event rules, and comply with any safety instructions from event staff or volunteers. Disruptive or unsafe behavior may result in removal from the event.

8. Media Release
Participant grants the Whispering Woods HOA and its authorized representatives the right to photograph, film, or record their likeness, image, and/or voice during the event. These materials may be used for promotional, publicity, or educational purposes in print, online, or on social media without compensation or further consent.
Participants who do not wish to be photographed or recorded must notify event staff upon entry and will be issued a wristband to designate their opt-out status.

9. Governing Law and Severability
This agreement shall be governed by the laws of the State of Florida. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment and Agreement
By RSVP’ing for this event or entering the event premises, I confirm that:

I am accepting these terms on behalf of all members of my household.

I am the parent or legal guardian for any minor children I am RSVP’ing for.

I understand that this waiver applies to my participation and that of my entire household.
